Terms of Service

These Terms of Service (“Terms”) are a small agreement between you and Soundporch about how you can use this website (soundporch.com) while we are in pre-launch. They cover the landing page and the beta waitlist only. They do not cover account creation, uploading music, royalties, or any other product feature; we’ll publish separate, fuller terms when those features go live.

1. About these Terms

In these Terms, “Soundporch”, “we”, “us” and “our” refer to the Soundporch project: the people building the platform you are visiting. “You” refers to you, the person reading this page. By accessing this site or submitting your email to the waitlist, you agree to these Terms. If you do not agree, please do not use the site or submit the form.

2. What this site is

This site is the pre-launch home of Soundporch, a community-first music platform for independent artists and the people who love their music. Right now it exists for two reasons: to explain what we are building, and to let people who want to be part of the beta join a waitlist. There is no product to sign into yet, no music to stream, no payments to make.

3. Joining the beta waitlist

When you submit the “Join the beta” form, you are giving us your email address and an indication of whether you are joining as a listener or as an artist. By submitting the form, you confirm that:

Joining the waitlist does not guarantee that you will be invited to the beta, that there will be a space for you when the platform launches, or that any particular feature will exist when it does.

You agree to use the site only for lawful purposes and in a way that does not infringe the rights of, restrict, or inhibit anyone else’s use of the site. In particular, you agree not to:

5. Intellectual property

The Soundporch name, logo, and the design, copy, and code of this site are owned by Soundporch. You may not copy, reproduce, republish, modify, or distribute any part of this site for commercial purposes without our prior written permission. You may, of course, link to the site, share it with friends, take a screenshot for personal use, or quote short excerpts in good faith (for example, in journalism or a blog post).

6. Third-party links and services

The site may contain links to third-party websites or services that are not operated by Soundporch. We have no control over those sites and accept no responsibility for their content, policies, or practices. The presence of a link does not imply endorsement.

The waitlist form forwards your submission to our email service provider, currently Kit (formerly ConvertKit), Inc. Your interactions with that provider are governed by their own terms of service and privacy policy in addition to ours.

Our handling of personal data is described in our Privacy Policy, which forms part of these Terms. Please read it before submitting the waitlist form.

The site is provided “as is” and “as available”. We do our best to keep it accurate, up to date, and reachable, but we make no warranties, express or implied, about:

To the maximum extent permitted by law, Soundporch and its contributors will not be liable to you for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with your use of the site or the waitlist, even if we have been advised of the possibility of such damages.

Nothing in these Terms excludes or limits any liability that cannot lawfully be excluded or limited under applicable law, including liability for death or personal injury caused by negligence, fraud, or fraudulent misrepresentation, or any consumer rights you have under the laws of the United Kingdom or Australia.

10. Changes to the site and these Terms

We may change, suspend, or discontinue any part of the site at any time, including the waitlist itself. We may also change these Terms from time to time. If we make a material change, we will update the “Last updated” date at the top of this page and, where appropriate, notify you by email. Your continued use of the site after a change indicates your acceptance of the updated Terms.

11. Governing law

Soundporch is built in the United Kingdom and Australia. The relationship described in these Terms is governed by the laws of England and Wales, without regard to its conflict of laws rules. If you live in a country whose consumer protection laws give you additional rights, those rights are not affected by this clause. Any dispute that cannot be resolved by talking to us first should be brought before the courts of England and Wales, although you may also bring it in the courts of your country of residence if local law requires it.
